Trial operation of waste treatment facilities is the operation to check, evaluate the effectiveness and compliance with environmental protection requirements for waste treatment facilities of investment project owners, facilities, concentrated production, business and service areas, and industrial clusters.
Article 46 of the Law on Environmental Protection No. 72/2020/QH14 stipulates environmental protection facilities and trial operation of waste treatment facilities of investment projects after being granted an environmental license.
According to the provisions of Decree 08/2022/ND-CP, except for some cases, all projects after being granted an environmental license must conduct trial operation of waste treatment facilities.

1. Subjects requiring trial operation
According to Article 46, Law on Environmental Protection No. 72/2020/QH14 stipulates the following groups of subjects requiring trial operation:
- Works and equipment for treating wastewater, exhaust gas, dust, solid waste, hazardous waste;
- Projects after completing environmental protection works and granting Environmental License (EPL) must conduct trial operation at the same time as the trial operation of the entire investment project or for each investment phase or for independent waste treatment works to assess effectiveness and compliance with technical standards.
In addition, Clause 1, Article 31 of Decree 08/2022/ND-CP also stipulates waste treatment facilities that do not need to conduct trial operations:

2. Conditions and duration of trial operations
a) Conditions for trial operations
According to Clause 2, Article 31 of Decree 08/2022/ND-CP
For projects that are not subject to environmental impact assessment (EIA), an Environmental License must be obtained and waste treatment facilities (except for facilities specified in Clause 1, Article 31 of this Decree) must be conducted at the same time as the trial operation of the entire project or for each phase of the investment project;
For projects that have an Environmental Impact Assessment (EIA) and have an Environmental Permit (EPL), waste treatment facilities (except for facilities specified in Clause 1, Article 31 of this Decree) must be tested for the entire project or each investment phase and project item according to regulations.
Projects specified in Clause 2, Article 39 of the Law on Environmental Protection must be tested after being granted an Environmental Permit (EPL).
b) Test operation period
Detailed regulations in Clause 6, Article 31 of Decree 08/2022/ND-CP:
- Projects with a high risk of causing pollution with a large capacity specified in Column 3, Appendix II of this Decree must be operated for 3-6 months.
- Other projects must be tested for no more than 6 months;
- Projects requiring an extension of the trial operation must have a written notice stating the time and reason for the extension, not exceeding 6 months.
