Environmental Registration
Environmental registration is a mandatory administrative procedure aimed at managing production and business activities that generate waste but are not subject to environmental permitting requirements.
1. Entities Subject to Environmental Registration

According to the Law on Environmental Protection and its guiding decrees, the following entities are required to carry out environmental registration:

Investment projects generating waste but not subject to environmental permits

Existing production, business, and service facilities generating waste but not subject to environmental permits
-
Projects or facilities with modifications or changes that fall under environmental registration requirements pursuant to Article 49 of the Law on Environmental Protection
-
Production households and facilities in traditional craft villages operating in non-encouraged sectors
-
Oil and gas exploration and prospecting projects (registration conducted at the commune-level People’s Committee where onshore waste is received)
Transitional Provision:
According to Decree No. 48/2026/NĐ-CP, projects and facilities that were granted environmental permits before the effective date of this Decree but are no longer subject to permitting requirements may continue to use their existing permits until expiry. These permits will become invalid if the project owner carries out environmental registration procedures or if the project/facility is no longer subject to registration.
2. Entities Exempt from Environmental Registration

The following entities are not required to register:
(1) Projects and facilities specified under Points a and c, Clause 2, Article 49 of the Law on Environmental Protection (as amended).
(2) Projects under Point b, Clause 2, Article 49 upon operation, and facilities that either do not generate waste or meet all of the following thresholds:

Hazardous waste: less than 20 kg/month or 240 kg/year

Industrial solid waste requiring treatment: less than 100 kg/month or 1,200 kg/year

Domestic solid waste: less than 300 kg/day
-
Wastewater: less than 5 m³/day; exhaust gas: less than 50 m³/hour, treated on-site or managed per local regulations
(3) Low-impact activities specified under Appendix XVI of Decree No. 08/2022/NĐ-CP, including:

Training, consulting, technology transfer, vocational education, marketing, and investment promotion
-
Production and distribution of television programs, films, audio recording, and music publishing
-
Mobile commercial services or retail shops with floor area under 200 m²
-
Food and beverage services with restaurant area under 200 m²
-
Household appliance repair, photocopying, internet services, and gaming services
-
Small-scale agriculture, forestry, aquaculture, and livestock farming at household level
-
Pilot plant cultivation under 1 hectare and individual housing construction
-
Aquaculture projects in marine, river, stream, or reservoir environments
3. Environmental Registration Dossier
As stipulated in Article 22 of Circular No. 02/2022/TT-BTNMT, the dossier includes:

Environmental registration form of the project owner/facility (Form No. 47, Appendix II under Circular No. 07/2025/TT-BTNMT)
-
Copy of the approved EIA appraisal decision (if applicable)
4. Procedures and Implementation Process
-
Receiving authority: Commune-level People’s Committee where the project or facility is located
-
Submission methods: Direct submission, postal service, or online public service portal
-
Responsibilities of the authority: Receive and update environmental registration data into the national environmental database system
5. Post-Registration Reporting Obligations
After registration, enterprises are required to submit periodic environmental protection reports:

Reporting template: Form No. 05.B, Appendix VI under Circular 09/2026/TT-BNNMT
-
Submission deadline: Before January 15 of the following year (reporting period: January 1 – December 31)

Receiving authorities: Commune-level People’s Committee and Department of Agriculture and Environment
6. Administrative Penalties
Violations related to environmental registration are sanctioned under Article 9 of Decree No. 45/2022/NĐ-CP:
For projects not subject to EIA:
-
Fine from VND 3,000,000 to VND 5,000,000 for late submission, incomplete registration, or failure to re-register
-
Warning or fine from VND 500,000 to VND 1,000,000 for non-compliance with registered commitments
For projects subject to EIA (provincial/ministerial level):
-
Fines may reach up to VND 30,000,000 for failure to carry out environmental registration
Note: The above fines apply to individuals. For organizations, penalties are doubled.
