EPR

Nanoen – The Extended Producer Responsibility (EPR) mechanism stipulated in Article 54 of the Law on Environmental Protection No. 72/2020/QH14 is a new development, playing an important role in financially supporting the circular economy of plastics, through the financial responsibility of producers to manage plastic products and the impacts on the end of life of packaging, as well as promoting comprehensive eco-design in the business sector.

To learn about EPR, please refer to more information in the article below with Nanoen!

What is EPR?

When bringing products to market, manufacturers are also responsible for collecting, sorting and recycling or having measures to safely treat waste from these products for the environment.

The development of EPR mechanism for packaging in the world

Sự phát triển cơ chế EPR đối với bao bì trên thế giới

EPR schemes have been evolving steadily since the late 1980s/1990s in Asia (e.g. Japan, Korea, Taiwan) and the European Union (e.g. France, Germany). They are also in early stages of development in some middle-income (e.g. India, Indonesia, Jordan, South Africa) and high-income (e.g. Chile, Singapore) countries and can be applied to all packaging waste (plastics, cardboard, glass, metals). While there are some voluntary cases, EPR schemes are generally mandatory and based on a legal framework.

How EPR works for packaging

Companies placing packaged products on the market can fulfil their responsibility individually for their own packaging. However, in practice this is complicated, so companies often join forces, delegate responsibility and make financial contributions to a producer responsibility organisation (PRO). Failure to fulfil this obligation can result in fines as set out in the legal framework and monitoring by the authorities. The contribution limit depends on the volume and type of packaging the company uses for its products, which must be reported to the PRO or a separate registered organisation. The amount payable also depends on the organisational and financial structure of the EPR scheme for packaging.
