Nanoen – Before Decree 08/2022/ND-CP took effect, the License to discharge wastewater into water sources was known as a type of water resource license issued by a state agency to organizations and individuals discharging wastewater into water sources and not subject to exemption from applying for a license as prescribed in Clause 3, Article 16 of Decree 201/2013/ND-CP.

The license to discharge wastewater into water sources is valid for a maximum of ten years, a minimum of three years, and can be renewed many times, each renewal is a minimum of two years, a maximum of five years (Point d, Clause 1, Article 21, Decree 201/2013/ND-CP).

Thus, from January 1, 2022, expired licenses for wastewater discharge into water sources will not be considered for extension, and facility owners, manufacturing enterprises, etc. must prepare a dossier to request a new Environmental License in accordance with the provisions of law.

Owners of establishments, manufacturing enterprises, etc. need to check the validity of the wastewater discharge license granted and choose the appropriate time to prepare the application for an Environmental License, to ensure that the application is completed and sent to the competent authorities before the wastewater discharge license expires 06 months (Point a, Clause 4, Article 30, Decree No. 08/2022/ND-CP and is subject to the license expiring at Point a, Clause 3, Article 44 of the Law on Environmental Protection).
