Which Enterprises Are Required to Obtain an Environmental Permit in 2026?

In particular, attention should be paid to the group of businesses currently using Environmental Permits with no specified validity period.

As the Law on Environmental Protection and its guiding regulations continue to be amended and refined, 2026 marks a critical milestone in the implementation of transitional provisions related to Environmental Permits. During this period, reviewing and standardizing existing environmental permits has become an urgent requirement for manufacturing and business facilities.

Enterprises Using Component Environmental Permits with No Expiry Date

Special attention should be given to enterprises currently operating under component environmental permits with no specified validity period, which were issued under previous regulations.

Pursuant to Clause 2, Article 42 of the Law on Environmental Protection 2020, such component environmental permits may only remain valid until before January 1, 2027.

After this date, if an enterprise has not completed the conversion procedure to the new Environmental Permit, the component permits will cease to have legal effect, and the facility will no longer meet the legal conditions for continued operation.

Accordingly, 2026 is considered the most appropriate time for enterprises to proactively apply for an Environmental Permit in order to:

Administrative Penalties for Operating Without an Environmental Permit

Enterprises must proactively review their regulatory status and prepare environmental permit applications early, especially during this transitional period.

Under Article 14 of Decree No. 45/2022/ND-CP, facilities that commence or continue operation without an Environmental Permit may be subject to administrative penalties, and may also face the risk of suspension of operations.

In addition, enterprises should be aware of common violations such as:

Failure to report changes from the approved Environmental Permit content to competent authorities for review and approval
Submission of Environmental Permit applications after the prescribed deadline

According to Article 11 of Decree No. 45/2022/ND-CP, penalties for these violations include:

Provincial-level permits: Fines ranging from VND 10,000,000 to VND 15,000,000
Ministerial-level permits: Fines ranging from VND 15,000,000 to VND 20,000,000

Note: The above fines apply to individuals. For organizations, penalties are doubled in accordance with current regulations.

Such violations may result in administrative sanctions and directly affect the lawful operation of facilities.
