However, during the trial operation of the project's waste treatment facilities, if the waste discharged into the environment does not meet environmental technical standards on waste, the Investor must make a plan to re-test the waste treatment facilities or each item of waste treatment facilities, and must also take the following measures:

Stop the operation or reduce the capacity of the investment project to ensure that existing waste treatment facilities can treat the types of waste generated to meet environmental technical standards on waste and environmental licenses.
Review waste treatment facilities, equipment, and operating procedures of the waste treatment system to determine the cause of pollution and propose solutions.
Renovate, upgrade, and construct additional (if any) waste treatment facilities to meet environmental protection requirements as prescribed.

In case of causing environmental incidents or environmental pollution:

The investor must immediately stop the trial operation and promptly report to the environmental licensing authority for guidance on handling;
In case the environmental licensing authority is the Ministry of Natural Resources and Environment, it must also send a report to the provincial environmental protection authority to coordinate in resolving environmental issues;
Be responsible for overcoming environmental incidents, compensating for damages and being handled for violations according to the provisions of law.
